Certain experts are of the view that the principle of finality debars the Supreme Court from reviewing its final judgment. This principle is aimed at ensuring legal certainty. But the rigid application of the principle of finality of judgment is not warranted in practice, as the abuse of process and miscarriage of justice, if left unremedied, would lead to defeating the very object and purpose of law. It has been suggested by modern legal scholars and jurists that the conflict between legal certainty and striving towards justness must be resolved in a way that law must bend where justice requires that.
